Version: July 2025

These Terms of Service govern the use of the website, online store, training programs, coaching services, and community forum of the Biontology® Training Institute FZ LLC. By accessing the website, purchasing training, registering for sessions, creating an account, or engaging with our services, you agree to be bound by these Terms.

Biontology® Training Institute FZ LLC – Terms of Service

1. Definitions

For the purposes of these Terms:

  • “Terms” refers to these Terms of Service and any updates published by the Institute on its website.
  • “Institute” refers to the Biontology® Training Institute FZ-LLC, a legal entity incorporated in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates, providing training, personal guidance, and educational services as described herein.
  • “Legacy Foundation” refers to the organisation that holds the intellectual property rights associated with the Biontology® system and governs licensing and certification standards. It operates independently of the Institute but authorises and oversees the permitted use of the Biontology® system through licensing agreements.
  • “Participant” refers to any individual who engages with the Institute’s services, including registered students, coaching clients, or users of the protected platform.
  • “License Agreement” refers to the agreement entered into between the Participant and the Legacy Foundation, which governs the Participant’s right to use the Biontology® system, including training eligibility and obligations.

2. Purpose and Scope of Service

The Institute provides structured training in the Biontology® system, as developed by Dr. Johan C. Boswinkel, according to the methodology and terminology overseen by the Legacy Foundation. Our services are limited to the delivery of educational content and support related to this modality. We do not offer therapeutic, diagnostic, or medical services, nor do we claim any specific health outcomes.

The Institute is not the official representative of Biontology® nor of the Legacy Foundation. It operates as an authorised training provider, delivering instruction and support within the scope of approved training materials.

3. Eligibility and Licensing

Training is open only to individuals who:

  • Have entered into a valid License Agreement with the Legacy Foundation, or
  • Have been expressly authorised by the Foundation to begin training under a provisional or special arrangement.

Training related to the professional use of the Biontology® is restricted to licensed users. Individuals who are not eligible or who misrepresent their status may be denied access or removed from training without refund.

Future additional programs may carry different eligibility criteria, which will be clearly stated at the time of enrollment.

4. Training Programs and Scope of Delivery

Training is delivered according to the description and limitations of the purchased program or service. This includes:

  • Biontology® Comprehensive Training Program
  • Foundational animal training program
  • Group sessions
  • Personal guidance hours
  • Optional development modules

Participation in the foundational Biontology® Comprehensive Training Program or animal training program is required for license holders and forms part of their contractual obligations under their License Agreement. Completing a training module or program does not constitute certification unless explicitly stated and approved by the Legacy Foundation.

Additional support beyond the purchased foundational training package must be arranged and paid for separately. Completion of any training module does not guarantee results, performance, or progression.

5. Personal Guidance and Coaching Services

5.1. Personal Guidance by the Institute

The Institute may offer personal guidance sessions delivered directly by its own team. These sessions fall under the Institute’s responsibility and are available either as part of training packages or as optional add-ons.

Personal guidance may be rescheduled with 48 hours’ notice. Late cancellations or no-shows are non-refundable unless otherwise agreed in exceptional cases.

5.2. Independant Coaching Sessions

The Institute also facilitates access to independent coaches licensed by the Legacy Foundation. These coaches operate in their own professional capacity. They are not employed by or supervised by the Institute.

While coaching sessions may be booked through the Institute’s online store for convenience, all services are delivered independently. Scheduling, execution, and any resulting concerns are the sole responsibility of the coach. The Institute is not liable for the content, outcomes, or fulfillment of these services.

6. Group Sessions

Group sessions may require a minimum number of confirmed Participants. The Institute reserves the right to cancel or postpone a session if this minimum is not met. In such cases, registered Participants may choose between a refund, credit, or transfer to a later session.

Cancellations by Participants:

  • With 7 or more days’ notice may be rescheduled subject to availability.
  • With less than 7 days’ notice are non-refundable and non-transferable.

Partial attendance does not entitle the Participant to a refund or price reduction.

7. Payments, Cancellations, and Refunds

All training must be paid for in advance. Registration constitutes acceptance of these Terms.

Participation in the foundational training program is a mandatory part of the License Agreement with the Legacy Foundation. Cancellations of this program are not accepted unless legally required. Once access to course materials is granted or the training has commenced, the service is deemed delivered and non-refundable.

Optional services such as coaching hours or supplementary modules are non-refundable once delivered. Where cancellation or rescheduling is permitted, it is subject to notice periods outlined in these Terms. Postponements for medical or force majeure reasons may be considered case by case.

8. Chargebacks and Payment Disputes

If payment is made using an online credit card payment platform in the online store environment, the Participant agrees not to initiate a chargeback without first contacting the Institute.

Unjustified chargebacks — particularly for training that is part of a License Agreement — may be deemed a breach of both these Terms and the License Agreement. The Institute reserves the right to:

  • Suspend access to all services and training materials
  • Notify the Legacy Foundation
  • Seek reimbursement and, if necessary, pursue legal action

9. Intellectual Property

All training content, instructional methods, terminology, assessment techniques, and supporting materials are part of a protected intellectual property framework developed by Dr. Johan C. Boswinkel and owned by the Legacy Foundation.

Participants agree:

  • Not to reproduce, record, translate, publish, or share any part of the materials
  • Not to use the training content outside of personal learning and authorised practice
  • Not to teach, present, or repackage the system under any form without explicit written permission

Violation of these protections may result in removal from training, denial of further access, legal enforcement, and reporting to the Legacy Foundation.

10. Independent Coaches and Forums

The Institute provides access to independently operating coaches who offer additional training and support related to the Biontology® system. These coaches are licensed by the Legacy Foundation and operate in their own professional capacity. They are not employed by, contracted by, or supervised by the Institute.

For the convenience of students and trainees, the Institute may facilitate bookings and process payments on behalf of these coaches through its online store or other integrated systems. However, the coaching services themselves are entirely independent. The Institute is not responsible for the scheduling, structure, delivery, content, or outcomes of any coaching sessions.

Any questions, concerns, or disputes regarding coaching sessions must be addressed directly with the individual coach. By purchasing or participating in coaching services offered through the Institute’s platform, you acknowledge that your agreement is with the coach, not the Institute.

The Institute also hosts access to various forums on the Biontology® community platform. Certain forums are used by independent coaches to engage with their clients or students. These coach-managed forums are provided as a convenience but are not monitored or moderated by the Institute. The only forums actively monitored by the Institute are those associated with the comprehensive training program, the foundational animal training and certification pathways.

11. User Accounts and Community Conduct

Participants who access restricted areas of the website or forum must maintain the confidentiality of their login credentials. Forum and platform access is a privilege that may be revoked.

You agree to:

  • Use forums respectfully and professionally
  • Not share or repost protected content
  • Avoid self-promotion or promotion of unrelated systems
  • Keep shared materials and discussions confidential

The Institute reserves the right to suspend or terminate access for any conduct deemed inappropriate or in breach of these Terms.

12. Platform Availability and Technical Access

While the Institute aims to ensure continuous access to materials and services, temporary interruptions may occur due to maintenance, third-party outages, or technical constraints. The Institute is not responsible for such interruptions or for the technical capabilities of the Participant’s own equipment or connection.

13. Disclaimer of Responsibility

The Institute offers training in a system that is not intended to diagnose, treat, or cure any medical condition. No claims are made regarding specific outcomes. Training is educational in nature and participation is at the discretion and responsibility of each individual.

By using this website or engaging in training, you acknowledge the separate, full disclaimer published here:

14. Data Protection and Privacy (GDPR)

The Institute complies with the General Data Protection Regulation (GDPR) and related data protection laws. By using the website, purchasing training, or creating an account, you consent to the processing of your personal data for the purposes of:

  • Service delivery and training access
  • Communication and support
  • Forum participation
  • Payment processing via third-party providers

We do not sell personal data. For full details, see our Privacy Policy.

15. Modifications to Terms

The Institute reserves the right to update these Terms at any time. Updates will be published on the website. Continued use of services after updates constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by, and construed in accordance with, English law as expressly chosen herein.

Any dispute, controversy, or claim arising out of or relating to these Terms, including their formation, existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Dubai International Financial Centre (DIFC) Courts. This choice is valid under DIFC Law No. 2 of 2025, which permits parties to opt in to DIFC jurisdiction regardless of geographic location.

This agreement applies irrespective of the Participant’s domicile or place of training, and notwithstanding that the Institute is incorporated in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates. All disputes shall be resolved within the DIFC Courts framework and under English law.

17. Force Majeure

The Institute shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters, extreme weather events, earthquakes, floods, epidemics, or pandemics
  • War, terrorism, civil unrest, or government actions
  • Internet outages, cyber-attacks, or third-party platform failures
  • Strikes, labour disputes, or supplier failures
  • Changes in law or regulatory requirements

During such events, the Institute will make reasonable efforts to minimise disruption and may:

  • Postpone training sessions or extend deadlines
  • Provide alternative delivery methods where possible
  • Communicate updates to affected Participants

If force majeure events continue for more than 60 days, either party may terminate affected services with reasonable notice. Participants will receive appropriate credits or refunds for undelivered services, subject to the circumstances and the Institute's ability to provide alternative arrangements.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. Any unenforceable term shall be interpreted in a way that reflects the original intent, to the extent legally permitted.
